Terms of Service
By engaging Digital Restaurant for website development, SEO, branding, or marketing services, you agree to the following operational terms and conditions.
1. Scope of Services & Deliverables
Digital Restaurant provides digital growth solutions tailored for food and beverage establishments. Specific project scope, timelines, deliverables, and revision rounds are outlined in your service proposal or project invoice.
2. Intellectual Property & Code Ownership
Upon receipt of final project payment, full intellectual property rights for your custom website design, master logo files, brand assets, and domain names are transferred completely to your business. Digital Restaurant retains rights to proprietary core templates, general reusable frameworks, and pre-existing marketing methodologies.
3. 0% Commission Ordering Guarantee
Digital Restaurant does not charge per-order commission fees on direct online ordering systems built on your domain. Standard third-party merchant credit card processing fees (e.g., Stripe, Square, or Toast processing at ~2.9% + 30¢) are paid directly to your payment gateway provider.
4. Client Responsibilities & Asset Submissions
Clients are responsible for providing accurate food menu pricing, high-resolution food photography, business credentials, and timely feedback during design reviews. Project timelines depend on prompt client communication.
5. Payment Terms & Billing
One-time projects (e.g., Logo Design, Website Build) are billed via deposit and final balance upon completion. Monthly retainer services (e.g., Google Maps SEO, Social Media Reels Management) are billed at the start of each monthly cycle.
6. Limitation of Liability
While we optimize websites for maximum conversions and search visibility, search engine algorithm updates, third-party platform policy changes (Google, Meta, UberEats), and local market conditions are outside our direct control. Liability is capped at the total fees paid to Digital Restaurant in the preceding 3 months.
